Alabama Homestead Exemption
The State of Alabama provides a Homestead Exemption or reduced tax for a property owner that owns a single-family residence and occupies it on the first day of the tax year for which they are applying. This reduced tax is less than one half that of the non homestead tax rate.
Rule 1 is that the owner must qualify; Rule 2 is that the owner must claim homestead before the deadline. Stated differently:
-
Rule 1: To qualify, the property must be owner-occupied as a homestead on October 1, 2005. If the house is empty on October 1, there will be no homestead exemption on the October 1, 2006 tax bill.
-
Rule 2a: If the new owner/buyer is living in the property on October 1, he must also claim his homestead exemption by December 31.
-
Rule 2b: If the seller is living in his homestead but sells it after October 1, the new owner does not need to worry about the December 31 deadline so long as he claims homestead before next fall. Naturally, he should claim homestead as soon as possible.
October buyers will not get a 2006 homestead exemption if they buy from an investor or if the seller claimed homestead but has already moved out. So, negotiate and schedule move-in/move-out dates appropriately.
