As many of you may know the Huntsville real estate management / investment community recently became aware of a proposal passed by an alliance of Huntsville area homeowners associations. The proposal, if adopted by the city of Huntsville would have been a huge overreach on the part of city government and been devastating to local homeowners, investors, property managers and the Huntsville real estate market.
 
On Friday February 10 a group of around one hundred concerned homeowners, investors and apartment managers  met to form a unified opposition group. There is little possibility of the ordnance passing by the Huntsville city counsel if it were presented and sponsored by a city counsel member but during the meeting a former Huntsville city employee indicated that the city did have other proposals regulating rental property under consideration. In the former employee's opinion those proposals were far more restrictive and damaging than the one we became aware of recently. The former city employee indicated that one of the proposals under consideration was limiting the number of rental units in specific areas of the city. The declining northwest Huntsville area was specifically mentioned.
 
During the meeting several attendees indicated that there were already city ordinances in place that regulated rental property maintenance and condition and that these ordinances were enforced in Huntsville by the office of community development. There were accusations of corruption within this specific office by attendees.
 
The attorney mediating the meeting suggested that concerned attendees meet by groups based on their interests in Huntsville rental and investment property. Property managers and realtors who manage rentals, managers of apartments and multi-family housing and property owners. These groups will make as many colleagues as possible know about the current and rumored proposals. The groups will then determine what courses of action they deem best.

During the meeting a member of the group of homeowners associations that initiated the know proposal attended. This member was also apposed to the proposed ordinance and believed that there were already adequate ordinances in place. The person stated that he didn't think that the group posed any real reasons for concern.
 
The attorney pointed out that the proposal we are aware of was very poorly written and and as written would include college dorms. retirement homes, city owned rental property and public housing homeless shelters and halfway houses.

The mayor and city counsel has already responded to the outcry over the proposed ordinance we are aware of. Based on their response we don't think the proposed ordinance will gain any traction at all. Of greater concern is the rumored ordinances under consideration and that the public just became aware of these.
 
As the various groups of real estate professionals meet and discuss courses of action we hope to open dialoge with the city to address the concerns of both owners of homes in declining neighborhoods as well as that of owners and real estate professionals.
